This case brought tears to my eyes today as i read it ????
The fact that the evidence rendered was from a minor who in this case is a victim was not corroborated, this man who was sentenced to 35 years with hard labour for defiling his daughter was recently acquitted !
He defiles his daughter and gives her genital warts, trial court convicts him 2014 and after appeal in 2019 Appeal Court acquits him!
Appeal Court in closing stated :
"I now therefore conclude by saying that it is for the above reasons that we set the appellant free. And now we quash the conviction by the trial coury, set aside the sentence imposed by the High Court and acquit the appellant".
The Law of Evidence demands that a child's testimony is corroborated (supported) but I still believe a 9 year old cannot just point at her father as being the abuser !! My heart bleeds with such a development!
