Did you know that marriage in Malaysia is governed by 3 different laws?
We have:
1. Civil law – is the law set by Parliament. Minimum age of marriage is 18 years old. However, girls between the age 16-18 may also get married with special permission granted from the Chief Minister of the state. This law does not cover Muslims or indigenous people
2. Islamic law (syariah) – is an Islamic law which stipulates minimum age of marriage to be 16 years old for girls and 18 years old for boys. However, the Syariah court judge may allow marriages under these age under circumstances the judge deems specials.
3. Native law – there is minimum age of marriage stipulated and marriage can occur at any age as long as the parents consent. Sabah has recently said that they will be stipulating a minimum age of 18 years old for marriage ????????
